MEMORANDUM OPINION AND ORDER

JOE KENDALL, District Judge.

Before the Court is the Opinion of the Fifth Circuit Court of Appeals remanding this case, filed December 10, 1999. The Court of Appeals Opinion directs this Court to determine if the Sergio Vasquez timely filed his notice of appeal. After reviewing the facts of this case, this Court finds that Vasquez's opinion was timely filed. Consequently, this case is returned to the Fifth Circuit for disposition.
