At 10:00 a.m. on Monday, September 30, 2024, this case will be called from the calendar of the Tax Court's trial session in San Antonio, Texas, pursuant to notice previously given (see Docs. 6, 9, 11).

On September 4, 2024, the Commissioner filed a motion (Doc. 10) to dismiss the case for the alleged lack of prosecution of the case by petitioner Manuel Vasquez, III. On September 6, 2024, we issued an order (Doc. 11) directing Mr. Vasquez to do three things: (1) Mr. Vasquez was to telephone the Court by September 13, 2024, but he has not yet done so, and he should do so immediately (at 202-521-0850). (2) Mr. Vasquez was to file a response to the Commissioner's motion by Friday, September 20, 2024, and we remind him of that impending deadline. (3) Mr. Vasquez is to appear at the trial session on September 30 for a hearing on the Commissioner's motion and, if that motion is denied, for the trial of his case. Mr. Vasquez should take care to fulfill these obligations.

On September 16, 2024, the Commissioner filed "Proposed Trial Exhibits" as Doc. 12, but the prefatory document was not signed by counsel or dated. Shortly thereafter, a corrected document was filed as Doc. 13. It is

ORDERED that Doc. 12 shall be stricken.
