MEMORANDUM OPINION


Luis Ernesto Vargas was convicted of felony driving while intoxicated. See Tex. Penal Code Ann. §§ 49.04, 49.09(b) (Vernon 2003 Supp. 2008). Punishment was assessed at five years' imprisonment, probated for five years, and a $2000 fine. We adopted the trial court's finding that appellant has abandoned the appeal. No clerk's record has been filed. Accordingly, we dismiss the appeal for want of prosecution. See Tex. R. App. P. 37.3(b).
