Appeal from the Erie Trial Term.

Present — Williams, P.J., Bastow, Goldman, Henry and Del Vecchio, JJ.


Judgment affirmed, with costs. All concur, except Williams, P.J., who dissents and votes for reversal and a new trial on the ground that the finding that the plaintiff was not guilty of contributory negligence was against the weight of evidence.
