DECISION & ORDER ON MOTION
Motion by respondent to dismiss an appeal from an order of the Civil Court of the City of New York, Queens County, entered September 19, 2013, for failure to prosecute, and, in effect, for the release of funds on deposit.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted, the appeal is dismissed, and the New York City Department of Finance is directed to release the funds on deposit in this matter to respondent Atanas Vanchev, less any lawful fees.
