JEREMIAH T. VANCE, Appellant v. DISCOVER BANK, Appellee

On Appeal from the 192nd Judicial District Court Dallas County, Texas Trial Court Cause No. DC-24-13090.

ORDER

ROBERT D. BURNS, III, CHIEF JUSTICE.

This is an appeal from an order denying a petition for bill of review of a default judgment awarding appellee monetary damages. Stating appellee has filed an application for appointment of a receiver, appellant has filed a motion to stay enforcement of the default judgment.

Under Texas Rule of Appellate Procedure 24, which governs the suspension of enforcement of judgments pending appeal, a judgment may be suspended only if it is being appealed. See Tex. R. App. P. 24. Because the default judgment is not on appeal, we DENY the motion.
