This case is calendared for a standalone remote trial at the session of the Court scheduled to commence on October 31, 2022.

On September 1, 2022, respondent filed a motion for summary judgment and a declaration of Nathan C. Johnston in support of motion for summary judgment. On October 16, 2022, petitioner filed a document titled "reply to order petr. by 10/17/22 file a response to resp. motion for summary judgment filed 9/1/22". Upon review of petitioner's document, the Court concludes that petitioner's filing is a response to respondent's motion for summary judgment and accordingly the Court will recharacterize petitioner's document filed October 16, 2022.

Upon due consideration of the foregoing, it is

ORDERED that petitioner's document filed October 16, 2022, is recharacterized as petitioner's response to respondent's motion for summary judgment. It is further

ORDERED that this case is stricken from the Court's October 31, 2022, standalone remote trial session and is continued. It is further

ORDERED that jurisdiction is retained by the undersigned.
