DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Nassau County, dated December 3, 2019, which was dismissed by decision and order on motion of this Court dated September 1, 2020, for failure to comply with a scheduling order dated February 18, 2020, issued pursuant to § 670.3(b)(2) of the rules of this Court (22 NYCRR 670.3[b] [2]). Motion by the appellant, inter alia, to vacate the dismissal of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
