PRESENT:

Respondent-respondent having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Monroe County, entered in the Office of the Clerk of said Court on July 10, 2017,

Now, upon reading and filing the affidavit of Neyda Mendez, sworn to August 22, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and

It is further ORDERED that Mark Funk, Esq., Monroe County Conflict Defender, 80 West Main Street, Suite 300, Rochester, New York 14614, is hereby assigned as counsel for respondent-respondent herein and may submit ten copies of respondent's brief reproduced in accordance with CPLR 5529.
