MEMORANDUM OPINION


On December 15, 2009, the Court abated this appeal pursuant to the Soldiers and Sailors Civil Relief Act until the earlier of November 30, 2010 or the date appellant filed a motion to reinstate the appeal. When appellant had not filed a motion by December 10, 2010, the Court reinstated the appeal. Because appellant had not paid the filing fee for the appeal before it was abated, we ordered appellant to either pay the $175 filing fee or file an affidavit of indigence within thirty days. We warned that if we did not receive either within the time specified, we would, without further notice, dismiss the appeal. See Tex. R. App. P. 42.3(c). To date, appellant has not paid the filing fee, filed an affidavit of indigence, or otherwise communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal.
