TIMOTHY KAYLON VALDEZ, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 291st Judicial District Court Dallas County, Texas Trial Court Cause No. F21-75126-U

DENNISE GARCIA JUSTICE

ORDER We REINSTATE this appeal.

We abated this appeal for the trial court to make findings of fact concerning appellant counsel Jeff P. Buchwald's failure to file appellant's brief. Mr. Buchwald told the trial court that his failure to file appellant's brief was due to his workload of over 200 appointed cases and from his computer crashing. Mr. Buchwald told the trial court that he can finish the final draft of the brief within the next sixty days. The trial court recommended granting Mr. Buchwald an additional sixty days to file appellant's brief.

We accept the trial court's recommendation. We ORDER Jeff P. Buchwald to file appellant's brief on or before JANUARY 16, 2024. If appellant's brief is not filed by that date, this Court may order Mr. Buchwald removed from representing appellant and order the trial court to appoint new counsel for appellant.
