Opinion
Case No. SC03-1884.
May 3, 2004.
Lower Tribunal No. 3D03-1054.
Petitioner has filed a petition for writ of mandamus. Petitioner has failed to establish a clear legal right to the reinstatement of Joseph Valdes v. Department of Children Family Services, case number 3D03-1054. To the extent that petitioner seeks relief other than reinstatement of the referenced appeal, he has also failed to establish a clear legal right to such relief. Accordingly, the petition is denied. See Huffman v. State, 813 So.2d 10, 11 (Fla. 2000) (stating that in order to be entitled to a writ of mandamus, petitioner must show a clear legal right to the performance of the requested act, that respondent has an indisputable duty to perform that act, and that no other adequate legal remedy exists).
