ORDER

David Gustafson Judge.

This case is currently calendared for trial at the Court's Columbia, South Carolina, trial session scheduled to commence April 8, 2024. On December 29, 2023, the Commissioner filed a motion (Doc. 8) to dismiss for lack of prosecution. The Court held a pretrial telephone conference with the parties on January 4, 2024, and the parties reported on the status of the case.

The Court appreciates the parties' work in developing this case. The Court encourages the parties to continue to cooperate in attempting to resolve the case by settlement, if possible. If the case does not settle, then the parties will need to prepare for trial. In view of the foregoing, it is

ORDERED that, the Commissioner's motion to dismiss for lack of prosecution will be held in abeyance. It is further

ORDERED that, no later than February 5, 2024, the parties shall file a joint status report (or, if that is not expedient, then separate reports).
