Petitioner/Cross-Respondent: The People of the State of Colorado, v. Respondent/Cross-Petitioner: Daniela Molina.

Court of Appeals Case No. 11CA1650

Petition and Cross-Petition for Writ of Certiorari GRANTED. EN BANC. :

Whether the court of appeals erred in concluding Colorado's identity theft statute, section 18-5-902, C.R.S. (2014), requires proof that the offender knew the information she exploited belonged to a real person, and if so, whether no rational juror could reasonably infer that an offender knew the last name and associated Social Security number she used to obtain employment and an apartment lease belonged to a real person.

Whether, in connection with the use of false identification documents, obtaining employment requiring work for pay or an apartment requiring payment for residence constitutes a "thing of value" under section 18-5-902, C.R.S.

Whether defendant's constitutional right to due process was violated and reversible error occurred when the trial court did not provide the jury with the proper definition of "thing of value" as contemplated by section 18-5-902, C.R.S.

DENIED AS TO ALL OTHER ISSUES.
