ORDER


The Federal Defendants' Motion to Stay was heard by the Court on April 23, 2003. Jeffrey B. Nelson represented the Federal Defendants; Paul W. Mortensen represented the Plaintiffs; and Stephen H.M. Bloch represented the Defendants-Intervenors. Based on the memoranda submitted by the parties and the arguments of counsel,

IT IS HEREBY ORDERED as follows:

1. The oral argument will proceed as scheduled at 9:30 a.m. on Wednesday, May 21, 2003, on the issues briefed by Plaintiff that are not resolved by BLM's revocation of the two closure orders affecting certain BLM-managed lands in Box Elder County.

2. If Plaintiff decides to assert any claim with respect to the new order published by BLM with respect to certain BLM-managed lands in Box Elder County, Plaintiff shall allege any such claim by filing an appropriate amended pleading within 30 days from the date of this Order. In the event Plaintiff files such a claim with respect to the new order in Box Elder County, the issues arising from Plaintiff's new claim or claims shall be briefed and argued separately from the argument to be held on May 21, 2003.
