Opinion

Case No. 2:02CR 0675DKW

May 28, 2003

ORDER

Based upon the motion of the parties to continue the trial date in this matter and for good cause appearing,

IT IS HEREBY ORDERED:

1. The three-day jury trial currently set for June 2, 2003, is stricken;

2. A two-day jury trial will begin on July 22, 2003, at 8:30 a.m.;

3. For the reasons stated in the parties' motion, the Court finds that the ends of justice served by granting the requested continuance outweigh the best interest of the public and the defendant in a speedy trial and therefore, the time from the stricken trial date to the new trial date is excluded from the computation of time required under the Speedy Trial Act, pursuant to 18 U.S.C. § 3161(h)(1)(I) and (h)(8)(A).
