MEMORANDUM OPINION AND ORDER


Having reviewed the facts stipulated and agreed to by both the government and the defendant and presented to the Court on May 15, 2003, it is the finding of the Court that Defendant Richard Williams ("Williams") is guilty as charged of violating Title 18, United States Code, Section 922(g)(1).

Williams is charged with unlawfully, willfully and knowingly possessing a firearm. On stipulated facts, Williams admits that on August 12, 2002, he willfully and knowingly possessed a .357 caliber Sturm Ruger Blackhawk pistol (the "Firearm") in the vicinity of 1368 Webster Avenue, the Bronx, New York. The government and Williams stipulate that the Firearm was manufactured outside the State of New York, and therefore had previously been shipped and transported in interstate commerce.

In addition, Williams admits that he was convicted on or about June 8, 1990 of criminal possession of a weapon in the third degree, a Class D felony, in New York State Supreme Court, Westchester County. Williams's prior conviction is of a crime punishable by imprisonment for a term exceeding one year.

Based upon these stipulated facts, the Court hereby finds the defendant, Richard Williams, guilty as charged in the indictment 02 Cr. 1210 (JFK).

SO ORDERED.
