Opinion

CASE NO. 2:00 CR 155 BSJ

May 14, 2003

PAUL M. WARNER, UNITED STATES ATTORNEY, LYNDA R. KRAUSE, Assistant United States Attorney, Attorneys for the United States of America, Salt Lake City, Utah.

ORDER

This matter is now set before the court for trial to commence on May 29 and 30, 2003. Based upon motion by the government to continue the matter, and stipulated thereto by the defendant, this court finds that due to the unavailability of an essential witness for the governments the ends of justice served by taking such action would outweigh the best interest of the public and the defendant. Pursuant to the government's motion, and for good cause shown, this court hereby strikes the trial setting and orders a new trial setting of June 23 and 24, 2003, 9:50 a.m.
