ORDER


On November 21, 2003 a preliminary hearing was held pursuant to Rule 40, F.C.R.P. in the above referenced matter. The United States was represented by James Loewenberg, Esq., Trial Attorney, Fraud Section, Criminal Division, Department of Justice. The defendant was personally present and represented by James Gilson, Attorney at Law. The Court received evidence and heard the arguments from counsel for both parties and finds:

Probable cause exists that the crime of Attempted Tax Evasion, a violation of 26 U.S.C. § 7201 was committed and the defendant committed the crime. The defendant is therefore ordered to appear before the United States District Court, Central Division of California no sooner than December 9, 2003 and no later than January 31, 2004.
