ORDER MOTION FOR TEMPORARY RELEASE AND ORDER


Comes now Defendant by and through his attorney Jerome H. Mooney and moves the Court to approve the temporary release as defined in the attached order. The terms and conditions of this release have been coordinated with Mr. Walz from the United States Attorney's Office in accordance with the direction of the Court on November 17th.

Under this order Mr. Wenger will be released on Saturday the 20th day of December, 2003. He will be allowed to travel directly from Salt Lake City, Utah to Phoenix, Arizona. He will be required to check in with the probation office both telephonically and in person. He will not leave the Phoenix, Arizona area. He will return to Salt Lake City, Utah on Sunday the 28th of December 2003 and present himself to the Marshals Office at 9:00 a.m. on Monday the 29th of December, 2003.

The purpose of the release is to allow Mr. Wenger to spend time with his ailing father in the Phoenix area prior to sentencing.

ORDER

On motion of the Defendant and stipulation of the Plaintiff, the Court Orders temporary release conditions for the Defendant as follows:

1. Defendant shall be released from custody prior to 11:00 a.m. on Saturday the 20th day of December, 2003.

2. Defendant will travel from Salt Lake City, Utah to Phoenix, Arizona on the 20th day of December. Airline schedule itinerary conforming to this order shall be provided to the Probation Office prior to Defendant's release. The Probation Office shall be provided with the address and telephone number for Defendant's temporary place of residence in Phoenix, Arizona.

3. Following his release, Defendant shall check in by telephone each day to the Probation Office in Salt Lake City, Utah.

4. Defendant shall also personally appear at the United States Probation Office in Phoenix, Arizona on the 22nd, 24th, and 26th days of December.

5. Defendant shall return to Salt Lake City, Utah on the 28th day of December, 2003 and shall surrender to the Marshal's Office prior to 9:00 a.m. on the 29th of December, 2003.
