ORDER OF DISTRIBUTION


Upon consideration of Motion to Distribute Funds filed by the United States, this Court finds the motion well-taken and appropriate.

It is hereby ORDERED, ADJUDGED, and DECREED, that the clerk is directed to pay the parties from the funds deposited into the registry of the court in the amount of $48,663.57, plus any interest which may have accrued, after deducting any court administrative fees, as follows:

1. To the Revenue Commissioner, Mobile County, for unpaid property taxes for the years 1994 through 2001, upon the property foreclosed upon in this suit, the amount of $13,141.65;

2. To Monfort, Inc., the amount of $11,500;

3. To the State of Alabama, for unpaid state income taxes for the tax year 1992, the amount of $5,317.38 as of February 19, 2002, plus $0.55 for each day thereafter through the date of payment; and

4. The remaining amount to the United States, c/o Wendy Vann, trial attorney, Tax Division, Department of Justice, P.O. Box 14198, Ben Franklin Station, Washington, DC 20044, in partial satisfaction of its judgment against defendant Louise M. Vito, and DJ Kennel, Inc., as nominee/alter ego of Louise M. Vito, for unpaid federal income taxes of Louise M. Vito, for the tax years 1988 through 1993, in the amount of $675,320.99, as of November 1, 1999, plus further interest and statutory additions thereon as allowed by law.
