ORDER PURSUANT TO DEFENDANT'S PRO SE LETTERS
This matter came before the Court pursuant to the defendant's pro se letters, each received in chambers on April 13, 2005. In one letter the defendant is requesting the Court's assistance for release of custody and the second letter alleges that his "civil rights" and "disability rights" are being "oppressed."
A review of the docket sheet reveals that on April 18, 2005, the Court issued an order directing the Government to file a response to the defendant's letters referenced herein [DE 73]. On May 4, 2005, the Government filed a response to the defendant's letters [DE 74].
After careful review of the defendant's letters and the Government's response thereto, it is hereby
ORDERED AND ADJUDGED that the defendant's letter/motion in which he seeks assistance from the Court in obtaining release from his term of imprisonment [DE 71] and letter/motion raising complaints regarding prison conditions [DE 72] are hereby denied without prejudice. The defendant is instructed that he must exhaust his administrative remedies and, if that fails, then he may file a properly prepared petition for relief under Title 28 U.S.C. § 2241 in the Eastern District of Texas.
