ORDER


This matter came before the Honorable Bruce S. Jenkins, United States District Judge, on June 7, 2004, for purposes of a sentencing hearing regarding Defendant Richard Anthony Thornock. The United States was represented by Special Assistant United States Attorney Samuel J. Schmidt, and the defendant was represented by attorney Robert Breeze. At the hearing the court considered a motion for enhancement of sentence pursuant to U.S.S.G. § 3B1.1(c). filed by the United States of America, and motions for downward departure pursuant to U.S.S.G. §§ 5K2, 3E1.1, and 4A1.3, filed by the Defendant.

After considering the motions, responses thereto, and arguments of counsel for the United States of America and Defendant, the following is ordered:

1. The motion of the United States of America, requesting a sentencing enhancement pursuant to U.S.G. § 3B1.1(c) is denied.

2. The motions of Defendant, requesting downward departures pursuant to U.S.S.G. §§ 5K2, 3E1.1, and 4A1.3 are denied.
