MEMORANDUM ORDER


The Government requests that we issue a bench warrant for the appearance of Ibrahim Suleiman (hereinafter "defendant") for the purpose of resentencing him in accordance with the recent decision of the Court of Appeals, United States of America v. Suleiman (2d Cir. Mar. 24, 2000) No. 98-1721 (to be reported at 208 F.3d 32), aff'g 29 F. Supp.2d 177 (S.D.N.Y. 1998).

The Court of Appeals ruled that defendant deserves further imprisonment "in the event he becomes available for resentencing." Id., slip op. at 2. The Court anticipated that the Government may seek to have defendant extradited for the purpose of such resentencing. Id. at 11, 12. It is consistent with the Court's wishes that we facilitate extradition in any way within our authority.

We are informed that the issuance of a warrant is a prerequisite to extradition proceedings.

Under the circumstances, we so issue a bench warrant for defendant's appearance.
