MOTION FOR LEAVE TO DISMISS, ORDER GRANTING LEAVE TO DISMISS, and DISMISSAL


Pursuant to Rule 48(a) of the Federal Rules of Criminal Procedure, the United States Attorney for the District of Utah hereby moves for leave to dismiss the above-captioned Violation Notice against defendant for the reason that the Defendant has fully complied with the Pretrial Diversion Agreement entered into with the United States on the 23rd day of October, 2003.

Subject to the Court granting the Government's Motion For Leave To Dismiss and pursuant to Rule 48(a) of the Federal Rules of Criminal Procedure, the above-captioned Violation Notice pending against the defendant, is hereby dismissed without prejudice.

ORDER GRANTING LEAVE TO DISMISS

Based upon the motion of the United States of America, and for good cause appearing, the Court hereby grants leave under Rule 48(a) of the Federal Rules of Criminal Procedure for the dismissal without prejudice of the above-captioned Violation Notice against the defendant.
