MOTION FOR LEAVE TO DISMISS, ORDER GRANTING LEAVE TO DISMISS, and DISMISSAL


Pursuant to Rule 48(a) of the Federal Rules of Criminal Procedure, the United States Attorney for the District of Utah hereby moves for leave to dismiss the above-captioned matter without prejudice for the reason that the Defendant has complied with the Diversion Agreement entered into by the Defendant and the United States Attorney.

Subject to the Court granting the Government's Motion For Leave To Dismiss and pursuant to Rule 48(a) of the Federal Rules of Criminal Procedure, the above-captioned matter pending against the defendant, is hereby dismissed without prejudice.

ORDER GRANTING LEAVE TO DISMISS

Based upon the motion of the United States of America, and for good cause appearing, the Court hereby grants leave under Rule 48(a) of the Federal Rules of Criminal Procedure for the dismissal without prejudice of the above-captioned matter against the defendant.
