STIPULATION AND ORDER CONTINUING CASE, VACATING DATES, AND EXCLUDING TIME


IT IS HEREBY STIPULATED by and between Assistant United States Attorney Kenneth J. Melikian, counsel for plaintiff, and Assistant Federal defender Jeffrey L. Staniels, counsel of defendant ROGER SCHEUERMAN, that the trial confirmation hearing now set for September 12, and the jury trial date now set for September 27, 2005, be vacated and the matter be scheduled for change of plea on this court's regular criminal calendar on October 3, 2005.

IT IS FURTHER STIPULATED that time for trial under the Speedy Trial Act, 18 U.S.C. 3161 et. seq. be excluded from September 12, 2005 through and including October 3, 2005, pursuant to 18 U.S.C. § 3161(h)(8)(A) (B)(iv), Local Code T-4.

IT IS SO STIPULATED.
