ORDER
After making an independent review of the pleadings, files and records in this case, and the Findings, Conclusions and Recommendation of the United States Magistrate Judge, I am of the opinion that the findings and conclusions of the Magistrate Judge are correct and they are adopted as the findings and conclusions of the Court.
IT IS, THEREFORE, ORDERED that the findings, conclusions and recommendation of the United States Magistrate Judge are adopted.
JUDGMENT
This action came on for consideration by the Court, and the issues having been duly considered and a decision duly rendered,
It is ORDERED, ADJUDGED AND DECREED that the motion be and it is hereby dismissed without prejudice to Movant's right to file a motion for leave to file a second or successive Section 2255 motion in the United States Court of Appeals for the Fifth Circuit pursuant to 28 U.S.C. § 2244 (b)(3)(A) and 2255.
IT IS FURTHER ORDERED that the Clerk shall transmit a true copy of this judgment and the order adopting the Findings, Conclusions and Recommendation of the United States Magistrate Judge to Movant.
