Opinion

98 Cr. 895 (SWK)

October 1, 2003

OPINION AND ORDER

Defendant Rasheed Sanni moves for a return of bond money in the above captioned matter. On September 15, 1998, Mr. Sanni posted a bond of $1,500 to secure his release on fraud charges for which he was arrested on July 6, 1998. Mr. Sanni, while on release, was then re-arrested and subsequently convicted of bank fraud. The standardized terms of Defendant's release prohibited him from committing any additional crimes. Thus, by undisputedly violating the conditions of his release, Mr. Sanni forfeited his right to have the bond returned. Defendant's motion is denied.

SO ORDERED.
