RECOMMENDATION REGARDING MOTION TO STRIKE SURPLUSAGE FROM FIRST SUPERSEDING INDICTMENT


Defendant Nai Ching Saelee moves the court to strike the "Sentencing Factors" pleaded in the First Superseding Indictment filed on December 15, 2004. Docket No. 20. The government filed a non-opposition to defendant's motion at Docket No. 28. Accordingly, said motion to strike should be granted. IT IS SO RECOMMENDED. This recommendation shall be treated as a final recommendation and forwarded to the assigned district judge for his determination.

IT IS SO ORDERED.
