Opinion

Case No. 04-40086-01-SAC.

ORDER FOR PRODUCTION OF EVIDENCE

NOW on this ____ day of January, 2005, the above-entitled matter comes before the Court upon the motion of counsel for the accused for an order producing the firearm identified as a "Remington brand, Model 870, `Police Magnum' 12-gauge pump-action shotgun, bearing serial number A867362M" for fingerprint analysis and to produce to defense counsel the fingerprints of Carly White. The Court understands that the government has no objection to producing the firearm and no objection to producing the fingerprints requested if they have already been taken, so grants the motion to that extent.

IT IS THEREFORE ORDERED that the government shall produce by February 4, 2005, the firearm identified as a "Remington brand, Model 870, `Police Magnum' 12-gauge pump-action shotgun, bearing serial number A867362M" and the fingerprints of Carly White if they have already been taken.
