Before the Court is the United States' Motion in Limine to Exclude Evidence Concerning Joint Defendants' Alleged Defenses of Vindictive Prosecution and Abuse of Process. Upon consideration of the United States' motion and Joint Defendants' opposition thereto, it is this 7th day of July, 2004:

ORDERED that the United States' Motion in Limine to Exclude Evidence Concerning Joint Defendants' Alleged Defenses of Vindictive Prosecution and Abuse of Process be and hereby is granted; and it is further

ORDERED that the defenses of vindictive prosecution and abuse of process are not defenses in this litigation; and it is further

ORDERED that all evidence, including testimony, exhibits, and argument, concerning the defenses of vindictive prosecution and abuse of process, including but not limited to: (1) evidence identified by Joint Defendants as supporting these defenses in their Motion to Compel Answers to Deposition Questions Relevant to Abuse of Process and Vindictive Prosecution; (2) evidence relating to the actions and motivations of any Executive Branch official, including former President Clinton and former Attorney General Reno, in supporting the filing of this lawsuit and the actual filing of this lawsuit; and (3) evidence relating to the Justice Department's evaluation of the legal merits of this lawsuit prior to its filing shall not be admitted into evidence at trial.
