SCHEDULING ORDER


At the June 10, 2004 arraignment, this court set the following schedule:

1) Discovery from the government has already been provided.

2) Defendant's pretrial motions are due July 23, 2004. Briefs need not accompany the motions. If defendant wants an evidentiary hearing on a motion, he must ask for it and provide a factual basis for holding such a hearing by way of a sworn affidavit or something similar.

3) The preliminary pretrial conference and any evidentiary hearing shall be July 28, 2004, at 11:00 a.m. Briefing on any remaining motions will be set at that time. A defendant may waive his presence at the preliminary pretrial conference, provided the court receives a written waiver.

4) Submissions for the final pretrial conference, namely proposed voir dire questions, proposed jury instructions and any motions in limine are due from both sides by August 18, 2004.

5) The final pretrial conference shall be August 20, 2004, at 10:30 a.m.

6) Jury selection and trial shall be September 7, 2004, at 9:00 a.m. The parties are to advise the clerk of court immediately if they determine that a jury will not be needed in this case. The predicted length of trial is one day.
