Opinion

Criminal No. 01-455-A

April 3, 2003

ORDER

ABC, Inc.; Associated Press; The Hearst Corporation; The New York Times Company; The Reporters Committee for Freedom of the Press; Tribune Company; and The Washington Post have filed a Motion to Intervene for the Limited Purpose of Being Heard in Connection With Access to Certain Portions of the Record ("Motion to Intervene"). Because the movants, as news organizations, have the right to be heard on the issues raised in their substantive motion, see, e.g., In Re Washington Post Co., 807 F.2d 383, 390 (4th Cir. 1986); In re Knight Publishing Co., 743 F.2d 231, 234 (4th Cir. 1984), the Motion to Intervene is GRANTED, and it is hereby

ORDERED that the parties respond to the intervenors' Motion for Access to Certain Portions of the Record ("Motion for Access") by Monday, April 14, 2003.

The intervenors have noticed oral argument of their Motion for Access for Friday, April 18, 2003. Because of docket and security considerations, oral argument of motions in this case is not held on Fridays. Accordingly, the Notice is DISMISSED.

After reviewing the parties' responses, the Court will determine whether oral argument will be of assistance in resolving the intervenors' Motion.

The Clerk is directed to remove oral argument of the Motion for Access from the April 18, 2003 docket and forward copies of this Order to the defendant, pro se; counsel for the United States; standby defense counsel; and counsel for intervenors.
