Opinion

Criminal No. 01-455-A

September 23, 2003

ORDER

In his pro se motion docketed as #1059, Mr. Moussaoui requests that he immediately be provided with a copy of the Government's position regarding sanctions, which he mistakenly believes should have been filed by 12:00 p.m. Friday, September 19, 2003. Because the Government's filing is not due until 5:00 p.m. Wednesday, September 24, 2003, the defendant's motion is DENIED.

The defendant is correct that the Court's first Order of September 11, 2003 directed the Government to file its response to any defense position regarding sanctions by 12:00 p.m. Friday, September 19, 2003. However, at the request of standby defense counsel, the filing schedule was modified by another order dated September 11, 2003 to require that any defense positions regarding sanctions be filed by 12:00 p.m. Friday, September 19, 2003, and any Government response be filed by 5:00 p.m. Wednesday, September 24, 2003. The Court Security Officer has been directed to submit counsel's filings for expedited classification reviews to facilitate Mr. Moussaoui's ability to respond no later than Monday, September 29, 2003.

The Clerk is directed to forward copies of this Order to the defendant, pro se; counsel for the United States; standby defense counsel; and the Court Security Officer.
