ORDER


Counsel for the United States and standby defense counsel have jointly submitted a proposed schedule for the resolution of issues concerning the use, relevance and admissibility of classified information in this case pursuant to the Classified Information Procedures Act ("CIPA"), 18 U.S.C. App. 3. The schedule proposes that we hold a closed hearing pursuant to Section 6 of CIPA on August 14, 2003, presumably after the Court of Appeals rules on the pending interlocutory appeal.

We find that counsel have articulated a reasonable basis for postponing the resolution of any CIPA issues, at least, for several months. However, the Court prefers to hold the hearing sooner to minimize any additional delays in this case which may be caused by an interlocutory appeal by the United States from an adverse ruling. Therefore, it is hereby

ORDERED that the closed CIPA hearing be placed on the Court's docket for Monday, July 7, 2003 at 10:00 a.m.; and it is further

ORDERED that counsel modify the proposed filing schedule to ensure that the Court receives the parties' final positions regarding the classified information at issue by Monday, June 30, 2003.

The Clerk is directed to forward copies of this Order to the defendant, pro se; counsel for the United States; standby defense counsel; and the Court Security Officer.
