ORDER


Upon consideration of the motion of defendant Microsoft Corporation to initiate discovery concerning new witnesses, and the motion of plaintiffs to take the deposition of one new witness, it is, this ___ day of October, 1998,

ORDERED, that defendant may take the depositions of Avadis Tevanian and James Gosling, and, to the extent not earlier produced, in conjunction therewith may require, at its election, the production of: (1) their curricula vitae; (2) their personnel records at Apple Computer, Inc., and Sun Microsystems, Inc., respectively; (3) any writings (including e-mails) authored by them respecting relations between Apple Computer, Inc., Sun Microsystems, Inc., and Microsoft Corporation; and it is

FURTHER ORDERED, that plaintiffs may take the deposition of Robert Muglia, and, to the extent not earlier produced, in conjunction therewith may require the production of similar documentation.
