ORDER


Before the Court is the United States' Motion for Preliminary Injunction if Mayer Refuses to Disclose Documents and Request for Hearing (Dkt. 38) and supporting Memorandum of Law (Dkt. 39). The United States bases its motion on the belief that the Defendant Mayer will not disclose certain documents on July 25, 2003, as directed by this Court in an order entered June 23, 2003 (Dkt. 33). Because the Court has no way of knowing at this time whether Defendant Mayer will or will not comply with the order, the motion is premature and must be denied without prejudice to being renewed in the event Defendant Mayer does in fact refuse to produce the documents.

ACCORDINGLY, the Motion for Preliminary Injunction and Request for Hearing (Dkt. 38) is denied.
