MEMORANDUM

This disposition is not appropriate for publication and may not be cited to or by the courts of this circuit except as may be provided by 9th Cir. R. 36-3.

Fernando Martinez-Rodriguez appeals his conviction and his sentence of 63 months imprisonment for being an illegal alien found in the United States following deportation and aggravated felony conviction, in violation of 8 U.S.C. § 1326(a) and (b)(2). His attorney has filed a brief pursuant to Anders v. California, 386 U.S. 738 (1967), and a motion to withdraw as counsel of record. Our review of the record discloses no issues for appeal.

Accordingly, we AFFIRM the district court's judgment and grant the motion of Fernando X. Gaxiola, Esq., to withdraw as counsel of record for appellant.
