MOTION TO CONTINUE TRIAL


Comes now defendant James Markham through his appointed attorney, Mark J. Gregersen, and requests a continuance of the three-day jury trial now set to commence in this matter on January 7, 2004 before Judge Cassell.

The reason for this request is that defense counsel desires further time in which to continue discussions with both his client and with the prosecutor as to questions concerning the evidence, and as to a possible resolution of this case.

Defense counsel has contacted the prosecutor, Mark Vincent, who agrees to a postponement of the trial in this matter. Defense counsel has spoken with defendant, and confirmed that the defendant shares the desire for a postponement. It is hereby agreed that the delay arising from such a postponement shall be deducted from the calculation of lime under the Speedy Trial Act.
