ORDER GRANTING PLAINTIFF'S MOTION FOR SERVICE OF PROCESS BY PUBLICATION


This matter comes before the Court on the United States' Motion for Service of Process by Publication. Pursuant to Fed.R.Civ.P. 4(e)(1), the Court may allow service of process as allowed by the law of Utah. The Court finds that under the circumstances of this case, Rule 4(d)(4) of the Utah Rules of Civil Procedure allows service of process by publication, and therefore the government's motion is appropriate. The Motion is hereby GRANTED, with the following requirements:

Process may be served by publication in both the Salt Lake Tribune and the St. George Spectrum. In each newspaper, publication must be made two different times at least one week apart. The publication shall include all information deemed pertinent to a normal service of process under Fed.R.Civ.P. 4(a), namely, the identities of the court and parties, the name and address of plaintiff's attorney, and the time within which the defendant must appear, as well as notification that failure to appear will result in a judgment by default.
