ORDER
The Court, having received the Stipulation of the parties dated May 1, 2003, and good cause appearing therefor,
IT IS HEREBY ORDERED, ADJUDGED AND DECREED:
1. Judgment was entered on November 3, 1997 in the total sum of $7,187.92 in favor of the United States of America (hereafter the "United States") and against Anatole M. (Tony) Long (hereafter "Long")
2. Long has agreed to pay and the United States has agreed to accept monthly installment payments from him in the amount of $66.00 commencing on the 15th day of May, 2003 and continuing thereafter on the 15th day of each month for a period of 6 months. At the end of said time period, payment in full will be made no later than November 15, 2003 by Long in the form of a certified check or money order made payable to the U.S. Department of Justice and sent to the Office of the United States Attorney, 185 South State Street, Suite 400, Salt Lake City, Utah 84111-1506.
3. In consideration of the mutual promises made in this Stipulation, the United States has agreed to subordinate its position in the upcoming purchase of a home by Long on the condition that Long agrees to strictly comply with the agreement set forth in paragraph 2, above. The United States also agrees to refrain from execution on the judgment so long as Long complies strictly with the agreements set forth in paragraph 2, above. Long hereby consents that in the event he fails to comply strictly with the agreement set forth in paragraph 2, above, the United States may move the Court ex parte for a writ of execution and/or a writ of garnishment or any other appropriate order deemed necessary for the purpose of satisfying the judgment in full.
