ORDER GRANTING UNITED STATES' REQUEST FOR RECONSIDERATION OF REPORT AND RECOMMENDATION ON DEFENDANT'S MOTION TO SUPPRESS AND EXCLUDE ALL RECORDS SUBPOENAED PURSUANT TO DOJ HEALTHCARE SUBPOENAS


Before the court is the December 29, 2004 motion of the United States of America asking the court to reconsider its Report and Recommendation granting the defendant's motion to suppress and exclude records obtained with DOJ Healthcare subpoenas. This motion was referred to the United States Magistrate Judge for determination. For good cause shown, the motion is granted.

The court granted defendant's November 23, 2004 motion to suppress based on the United States' failure to file a timely response to the motion. The United States concedes that its system of responding to the numerous motions filed in this case is flawed. Moreover, the United States asserts that this system will be adjusted to ensure timely responses to all future motions filed by the defendant. Accordingly, the court grants the United States' request for reconsideration. The United States shall respond to defendant's November 23, 2004 motion within eleven (11) days from the date of this order.

IT IS SO ORDERED.
