ORDER

A hearing was held in this matter on December 16, 2004, before United States District Judge Barbara B. Crabb. The government appeared by Peter Jarosz and Heidi Luehring. Defendant appeared in person and by counsel, David Geier.

Ms. Luehring advised the court that the government believes that Mr. Koehler has purged his contempt by cooperating with the government in the provision of financial information and by making an effort to liquidate certain assets to pay his restitution.

Accordingly, IT IS ORDERED that defendant Michael Koehler is purged of his contempt as of today, December 16, 2004. The sentence imposed upon him on February 14, 2003, is no longer tolled.
