ORDER TO VACATE


Plaintiff United States of America, having requested and been granted the foreclosure of its liens upon the real properties commonly known as 145 02 Park Lake Court in Farmers Branch, Texas and 315 325 Sunset Avenue in Dallas, Texas ("the Properties"), more particularly described on the attached Exhibit 1, and the United States having requested an order of this Court that Defendant Dr. James David Key, Sr. ("Key") and all other persons acting in concert with, or on behalf of him, or residing thereon, vacate and depart from the Properties within 20 days of the date this Order is entered, and good cause having been found,

IT IS ORDERED that Defendant Dr. James David Key, Sr., Carolyn D. Putney, and all other persons acting in concert with, or on Key's behalf, or residing thereon, shall, no later than 12:00 o'clock noon onMay 15th 2004, vacate and depart from the Properties, and

IT IS FURTHER ORDERED that the United States Marshal is authorized and directed to enforce this Order at any time that he deems appropriate after 12:00 o'clock noon on May 15th 2004 entering the Properties, and any and all structures and vehicles located thereon, (2) evicting any unauthorized persons from all locations on the Properties, including but not limited to, the structures, vehicles, and grounds, and (3) using force as necessary 10 accomplish this mission. When the United States Marshal concludes that all unauthorized persons have vacated, or been evicted from the property, he shall relinquish possession and custody of the Properties, and any personal property found thereon, to the Receiver Allie Beth Allman or any other person appointed by a separate order of this Court, and

IT IS FURTHER ORDERED that, should Dr. James David Key, Sr., Carolyn D. Putney, or any person acting on his behalf, or in concert with them, or residing thereon, either fail to vacate and depart from the Properties by 12:00 o'clock noon on May 15th 2004 or attempt to enter onto the Properties after that date and time, that person may found in contempt of this Court, and

IT IS FURTHER ORDERED that the United States Marshals Service, within ten days of the entry of this order, provide notice of it to Dr. James David Key, Sr., by personal service at 14502 Park Park Lake Court in Farmers Branch, Texas.

EXHIBIT 1

PROPERTY 1:

BEING lot 11 in Block "M", located and situated in the replat of Oakbrook Estates, an addition to the City of Farmers Branch, Dallas County, Texas, according to the map thereof, recorded in Volume 78141, Page 819, map records of Dallas County, Texas; located at 14502 Park Lake Court in Farmers Branch, Dallas County, Texas 75234.

PROPERTY 2:

Being Lots 4, 5, 6, 7, 8, 9, and 10 in Block 42/3162 of DALLAS LAND LOAN COMPANY'S ADDITION TO OAK CLIFF, an Addition to the City of Dallas, Texas, County of Dallas, also known as 315 Sunset Avenue and 325 Sunset Avenue in Dallas, Texas 75208.
