ORDER


This matter is before the Court on the motion of plaintiff United States of America to dismiss the portion of this civil action which has not been resolved. On September 6, 2002, the Court entered a money judgment against defendant Kent Johnson which resolved the United States' claim to reduce federal tax assessments to judgment. Therefore, the only remaining claim is the portion of this action which seeks to foreclose the federal tax liens related to the aforementioned assessments against certain real property. The United States and defendant Phyllis Sandberg, the individual holding title to the real property at issue, have reached a settlement and entered into a Stipulation filed with the Court. Therefore, upon motion of the United States, and for good cause shown, it is hereby ORDERED that the remaining portion of this civil action is dismissed with prejudice; and it is further

ORDERED that defendant each party shall bear their own costs, including any attorney's fees.
