PETITIONING THE COURT

To issue a WARRANT.

On October 10, 2023, Mr. Jennings supervised release was revoked. Your Honor ordered Mr. Jennings' release directly to inpatient treatment on October 24, 2023. Since his release, Mr. Jennings has not reviewed his current judgment and sentence with the undersigned officer.

The probation officer believes that the offender has violated the following conditions of supervision:

Violation Number Nature of Noncompliance

1 Mandatory Condition #1 : You must not commit another federal, state or local crime.

Supporting Evidence : Mr. Jennings allegedly violated the above-stated condition on November 13, 2023. On that date, Mr. Jennings was charged by Spokane County Sheriff's Office (SCSO) for fourth degree assault, pursuant to SCSO case number 2023-10171109.

According to SCSO case number 2023-10171109, on November 13, 2023, officers were assigned to a call of an assault that occurred at American Behavioral Health Systems (ABHS). On that date, the victim of the crime reported that Mr. Jennings had assaulted him at the ABHS treatment facility by striking his face with his fist. Law enforcement officers interviewed others and reviewed video surveillance and confirmed Mr. Jennings was the assailant. Mr. Jennings was located at a nearby restaurant and cited and released for the aforementioned behaviors.

At the time of this petition, Mr. Jennings is at liberty and the charges remain pending.

2 Standard Condition #9: If you are arrested or questioned by a law enforcement officer, you must notify the probation officer within 72 hours.

Supporting Evidence: Mr. Jennings allegedly violated the above-stated condition on November 17, 2023.

According to SCSO case number 2023-10171109, Mr. Jennings was cited and released for fourth degree assault on November 13,2023. Mr. Jennings has not contacted the undersigned officer or U.S. Probation Office to disclose his contact with law enforcement within 72 hours. Furthermore, attempts to reach Mr. Jennings have all been unsuccessful.

3 Special Condition #3: You must undergo a substance abuse evaluation and, if indicated by a licensed/certified treatment provider, enter into and successfully complete an approved substance abuse treatment program, which could include inpatient treatment and aftercare upon further order of the court. You must contribute to the cost of treatment according to your ability to pay. You must allow full reciprocal disclosure between the supervising officer and treatment provider.

Supporting Evidence: Mr. Jennings allegedly violated his conditions of supervised release by being unsuccessfully discharged from substance abuse inpatient treatment on November 13,2023.

On November 14,2023, the undersigned officer received a call from Mr. Jennings' assigned treatment counselor with ABHS to discuss his noncompliant behaviors. Specifically, Mr. Jennings had violated ABHS protocol by using violence against another client. Additionally, Mr. Jennings aborted treatment against advice on November 13, 2023, resulting in his termination.

The U.S. Probation Office respectfully recommends the Court issue a WARRANT requiring the offender to appear to answer to the allegation/s) contained in this petition.
