ORDER DIRECTING DEFENDANT TO FILE FINANCIAL AFFIDAVIT (CJA 23)


Before the court is the September 27, 2005 motion of defendant Omar Abdi Jamal for leave to appeal in forma pauperis and requesting appointment of his pro bono counsel for the purpose of appeal. Jamal was represented by pro bono counsel and was never qualified for appointment of counsel.

In order to consider Jamal for in forma pauperis status, the court requires a completed financial affidavit.

The clerk is directed to send the attached Financial Affidavit form to Jamal in care of his pro bono counsel, Peter Erlinder. Upon receipt of the form, Jamal is directed to complete the form and return it to the court. If the form is not returned, a hearing will be set and Jamal will have to appear personally.

IT IS SO ORDERED.
