STIPULATION FOR DISMISSAL OF ACTION; ORDER THEREON


Plaintiff Masino Plastering, Inc. ("Masino"), on the one hand, and defendants Intertex, Inc., and XL Specialty Insurance Company (collectively "Intertex"), on the other hand, by and through their respective counsel, stipulate as follows:

1. Masino filed its Complaint against Intertex alleging money due on a payment bond under the Miller Act, 40 U.S.C. § 270a-270e.

2. The parties have settled their differences, and desire to dismiss this action . . .

3. Accordingly, the parties agree that this action should be dismissed with respect to all causes of action, without prejudice.

SO STIPULATED.
