Case No. 2:03 CR 00902 TC (D. Utah Dec. 30, 2003)

Opinion

Case No. 2:03 CR 00902 TC

December 30, 2003

Jon D. Williams, RASMUSSEN MINER, Salt Lake City, Utah, for Defendant

ORDER

Based upon the motion filed by the Defendant to continue the original trial date and thereby waive his right to a speedy trial, it is hereby ORDERED

that the trial date of January 29-30, 2004, is hereby stricken. The Court finds that pursuant to 18 U.S.C. § 3161 (h)(8)(a) the continuance serves the ends of justice and outweighs the interests of the public and the Defendant in a speedy trial. The basis for this Order is the fact that the Defendant has requested additional time to engage in plea negotiations. The Court will set a new trial date.
